Information on 42 CFR 482: Medicare and Medicaid Programs; Hospital Conditions of Participation: Patients’ Rights

Effective January 8, 2007, the US Department of Health and Human Services Centers for Medicare and Medicaid Services (CMS) passed rules relating to the use of restraint and seclusion in all Medicare and Medicaid participating hospitals. Among other things, these new regulations provide specific training requirements to include demonstrated competency in the application of restraints; periodic refresher training; the use of nonphysical prevention and intervention skills; and information and recognition of patient distress such as positional asphyxia.
